Notwithstanding anything else written in this paragraph, if any party to the case makes an application to the court showing that a witness cannot be present in the court due to extreme old age, physical infirmity, ill-health and being outside the court, if the court deems it reasonable to do so. The court may order the examination of such witnesses through audio-visual communication.
(2) If there is an order according to sub-section (1), the concerned party shall bring such witness to appear on the day and place specified by the court to examine the witness through audio-visual communication.
(3) The court shall consider the witness present in the audio-visual communication as the same as the witness present in the court and examine or cause to be examined.
(4) When the witness is examined in accordance with sub-section (3), the court shall record the transcript of the witness through the audio-visual communication and the recording of the audio-visual communication.
(5) The court shall arrange for the deposition of the records of the witness through audio-visual communication in accordance with Schedule-15.
(6) In accordance with this section, the expenses incurred in the examination of the witness shall be borne by the party making the application for the examination of the witness through audio-visual communication.
